All foreign companies whose activities in the Internet are aimed at Russia must formalize their presence in Russia

Law No. 236-FZ on Operation of Foreign Entities in the Internet in the Russian Federation has come into force since 1 July 2021. The new law has been non-officially called the “law on IT companies landing". Now all foreign companies whose activities in the Internet are aimed at Russia must formalize their presence in Russia.

The innovations relate to the owners of Internet sites, website pages or computers visited by more than 500 thousand users located on the territory of the Russian Federation during a day provided that one of the following conditions is observed:

  1. The information in the state language of the Russian Federation is provided or distributed by this information source;

  2. Advertising aimed at attracting the attention of consumers located in the Russian Federation is distributed by the information resource;

  3. The foreign entity processes information about the users located in the Russian Federation;

  4. The foreign entity receives money from Russian individuals and legal entities.

Moreover, the new law also covers the foreign companies that:

- arrange placement of information resources in the Internet with users in Russia, for example, hosting providers;

- they are the operators of advertising systems with help to distribute advertising in the Internet for Russian consumers;

- ensure operation of software for computers and information systems for receiving, transmitting, delivering and processing e-messages of the Internet users located in the Russian Federation.

Among the duties imposed on the foreign companies by the law on IT companies landing, it should be noted that it is necessary to formalize its presence in Russia by establishing a branch or a representative office, or a Russian legal entity.

Please note that in case of non-compliance with the provisions of the new law, the following consequences are possible for a foreign entity:

  1. The users of the foreign entity’s information resource will be notified of violation of the Russian laws by said entity;

  2. Distribution of advertising of the foreign entity or its information resource as an advertising item will be prohibited;

  3. Distribution of advertisement on the foreign entity’s information resource will be prohibited;

  4. Money transfers and acceptance of payments from individuals and legal entities in favor of a foreign entity will be restricted;

  5. Search results will be banned;

  6. Collection and cross-border transfer of personal data will be prohibited;

  7. Access to an information resource will be restricted fully or partially.
